States and nonprofits sue feds for illegal withholding of $5B in EV charger funds

The NEVI (National Electric Vehicle Infrastructure) program has been a critical initiative established by the Infrastructure Investment and Jobs Act (IIJA) to expand EV chargers across the country. With $5 billion in funding earmarked for this purpose, the goal is to increase access to EV ownership, unlock fuel cost savings, and promote cleaner air in communities with high EV penetration.

Every state has submitted plans to utilize the allocated funds, resulting in various levels of completion for charging station projects nationwide. Tesla’s decision to open up its charging port and create the NACS standard was a direct response to the law’s requirement that federal funding only support charging stations with open access to multiple vehicle brands. This move by Tesla has been instrumental in addressing many challenges associated with EV charging.

However, the progress of the NEVI program was abruptly halted when the Federal Highway Administration (FHWA), under the direction of former President Trump, froze funding for the program in February. This action was met with backlash from 17 states, led by California, Colorado, and Washington, who are now suing the FHWA to release the allocated funds.

California Governor Gavin Newsom and Attorney General Rob Bonta have highlighted the detrimental impact of withholding the funds, citing it as another instance of favoring China over American innovation. The lawsuit aims to overturn the illegal funding freeze and ensure that the NEVI program can continue its efforts to bolster the EV industry in the US.

Despite opposition from the Trump administration and ongoing efforts by some Republicans to raise the cost of EVs, initiatives like the NEVI program and the Inflation Reduction Act have been instrumental in driving investment and job creation within the American EV manufacturing sector. The lawsuit against the FHWA seeks to uphold the law and prevent further hindrance to the growth of the EV industry.
